Can my HOA in Arizona charge rental properties only for the Crime Free Lease Addendum?
I have a rental property (detached single family home) in Buckeye, AZ and the HOA wants to charge me $150.00 to sign their Crime Free Lease Addendum. The HOA says the fee goes to a management company that handles the CFLA portion. Is it legal for the HOA to only charge rental properties in the community? This seems a little discriminatory. Also, is the fee of $150 a fair price? And lastly, the addendum the HOA sent me is different from all the AZ addendums I see on the web for AZ. This addendum says that I approve of background checks to be run on both the tenants and the property owners. I haven’t seen this portion of the addendum anywhere else. Any help would be appreciated. Yes it is legal. An HOA is a self governing body that serves the interests of the community. They can approve all kinds of fees it deems necessary and most everything is put to a vote before approval is executed. As an owner you are a member of this governing body and could repeal this fee in the future with participation on your part. It is not illegal to single out the non-owner occupied units just as it isn’t illegal for your home owners insurance company to charge you higher rates on your non-owner occupied property.
